2. INFORMATION AND STATEMENTS PRIOR TO CONTRACTING

Prior to contracting and during the purchase process, the Client may access, archive and print these general terms and conditions for consultation.

All information and personal data provided by the Client when using this website will be processed in accordance with ECO-BLU's Privacy Policy, in accordance with the data processing specified in these Terms of Purchase and in accordance with the options marked by the Client at the time of acceptance of the Conditions of Purchase. The Client declares that all the information and data provided to ECO-BLU are true and correspond to reality. If the Client does not provide all the necessary information, their order cannot be processed.

The Client undertakes not to place any false or fraudulent order, ECO-BLU reserving in these circumstances the right to cancel it and take the appropriate actions.

The Client declares that he/she is over 18 years of age and has the necessary and sufficient legal and legal capacity to enter into contracts of economic content.

In the case of legal entities, the natural persons acting on their behalf and representation, through this site, guarantee to ECO-BLU, and third parties linked to the provision of the contracted services, that they hold sufficient representation in their favor by the corresponding legal entity at the time of making the purchase and guarantee that at the time of making the transaction they are not violating the rights of any third party in this regard and that the Data and information relating to legal persons are truthful, accurate and reliable.

ECO-BLU will not be responsible for any damage, loss or harm to people and/or property that are caused by or related to the above declaration.

3. GEOGRAPHICAL SCOPE

The products offered through this website are only available for delivery or collection in Spanish territory, except the Canary Islands, Ceuta and Melilla.

4. ECO-BLU PRODUCTS

The Client declares that he is aware that all the products sold at ECO-BLU are intended for exterior carpentry in vertical parameters for use in public or domestic use and have been subjected to test methods in accordance with the corresponding norms and standards. However, some items in the assortment have been tested for professional or public use and meet the safety, durability and stability requirements set out in the technical standards for such use. The warranties offered by ECO-BLU with respect to all its products are generally conditioned to their domestic use. The Client must, in any case, and before purchasing an ECO-BLU item, ensure that it is suitable for the use they wish to give it. To this end, there are fact sheets for each product available for consultation on the ECO-BLU website www.eco-blu.es ECO-BLU is not responsible for any possible claims arising from a use other than that for which the article is designed. The Client declares that it is aware that ECO-BLU does not have management systems certified in accordance with international standards (ISO9000, ISO 14000, EMAS, SA8000, etc.). ECO-BLU aims to ensure that the ECO-BLU brand is in itself a guarantee of trust for its customers, both in the processes they follow and in the articles they sell with respect to the issues of quality, safety, environment and corporate responsibility. To this end, it has internal management systems and protocols that cover all its processes and that it audits internally to ensure that they are carried out correctly in all its units. The manufacture of its products is subject to ECO-BLU's own quality, environmental and corporate responsibility standards, based on international principles and which are common to those established in the standards such as those mentioned above.

5. TECHNICAL MEANS TO CORRECT ERRORS

This website displays confirmation windows for the data provided, which may not allow you to proceed with the purchase if the data you enter is not in the correct format. In any case, before making the payment, the Client will be able to view the selected products and the details of their order on the website so that they can modify the details of their order if necessary. 6. HOW TO PLACE AN ORDER

To place an order, the Customer must select from the ECO-BLU website the products to be purchased by creating a virtual shopping list.

The Client must have followed the following steps before placing the order:

1. Read and understand the description of the products as they appear on this website. In case of doubt, the Client should contact ECO-BLU via email pedidos@eco-blu.es or by calling the Customer Service contact number at + 34 660 832 041.

2. Read and understand the essential and technical characteristics of the products, which are available in the product information and technical information sections of the website. These include any statement relating to technical standards and performance relevant to the intended use of the product.

3. Check the website for the indicated price of the products and the possible promotions that may apply, being able to view and know the final price including VAT or tax that may be applicable, as well as the price of the selected transport service and the cost of collection in Store. It is informed in advance and the Client expressly acknowledges and accepts that the price of the items listed on the ECO-BLU website may vary, only downwards, depending on the promotions in force on the ECO-BLU website.

In case of conformity, the Client must make the payment by clicking on the "Pay now" button. After payment, ECO-BLU will immediately inform you by email of the confirmation of your order and send you your Purchase Order.

ECO-BLU will provide the customer with a link in the order confirmation email that will allow them to view the status of their order.

7. AVAILABILITY

ECO-BLU will display updated information on the availability and stock of the products on its website. Even so, it is possible that a product, whose availability has been confirmed by ECO-BLU, has been sold out during the order process, so, in this case, ECO-BLU will inform the Customer of this situation through email and/or telephone, and will offer the following alternatives:

- The delivery of the product in a longer period than initially indicated, subject to the Client's agreement with this solution, at no additional cost.

- The refund of the price charged within a maximum period of three working days, from the indication by the Client that this is the chosen alternative, by the same means of payment used at the time of paying for the order. In the event of a total return of the order, the amount to be refunded will include the costs of the delivery service of the product that the Customer would have paid. In the event of a partial return, in which the items subject to the return of the item will change the characteristics of the delivery method of the initial order, and therefore the price of the service, this price difference will be adjusted in the return.

8. PRICE AND PAYMENT

The prices of the products that appear on the website include VAT and are the current ones at all times, including the current promotions that may be applicable.

The Client may use PayPal, VISA and Mastercard credit or debit cards or bank transfer as a means of payment.

All orders will be dispatched once payment has been made and confirmed by ECO-BLU.

8. INVOICING

The Client will receive their invoice, in digital format, by email at the time of confirmation of the purchase, for the purchase of the products and services contracted.

9. DELIVERY

ECO-BLU will send the order within the period agreed with the Client according to the delivery method. "Delivery" shall be deemed to have occurred when the Client or a third party designated by him acquires physical possession of the products.

To confirm that the delivery is made, the customer must sign the delivery note of the order.

The delivery times indicated after the validation of the order will be calculated in working days (Monday to Friday except holidays).

All deliveries will be made "AT STREET LEVEL" and must be accessible to transport vehicles. In the event of difficulty of access (narrow passage, insurmountable obstacles, snow, etc.) the delivery cannot be made and will result in an extra cost. If for any justified reason, the Client needs to change the delivery address, they must communicate this by email to pedidos@eco-blu.es indicating the new data.

No delay shall entitle the child to any compensation. We are not responsible for delays attributable to our suppliers/transport agencies or in the event of force majeure.

10. AFTER-SALES SERVICE

In the event that the Client has an incident with the management of the receipt or collection of their order or with the content of the same, they must contact ECO-BLU. Likewise, the Customer may contact ECO-BLU Customer Service by telephone at + 34 660 832 041 or through the email address pedidos@eco-blu.es from 06:00 a.m. to 3:00 p.m. from Monday to Thursday and from 06:00 a.m. to 2:00 p.m. on Fridays.

11. CANCELLATION, WITHDRAWAL AND RETURN

Order cancellation

The order may be cancelled within 1 hour after the order is placed and as long as it is cancelled more than 48 hours before the delivery date. In this case, ECO-BLU will proceed to refund the full amount of the purchase, including the cost of transport, if any. The Client may contact ECO-BLU BLU by telephone at + 34 660 832 041 or via the email address pedidos@eco-blu.es from 06:00 a.m. to 3:00 p.m. from Monday to Thursday and from 06:00 a.m. to 2:00 p.m. on Fridays.

In these cases, the total price will be paid by the same payment system used at the time of payment of the order within a maximum period of three working days from the communication of the cancellation.

After this period, ECO-BLU does not guarantee that the order has not left our premises. If this is the case, the transport costs of the goods previously paid will be deducted from the refund of the amount.

Right of withdrawal

Once the goods have been received, the Customer, if they are a consumer, will have 14 calendar days from the receipt of the last of the products purchased in the same order to exercise their right of withdrawal.

In the event of withdrawal, ECO-BLU will refund to the Client, in the same means of payment used by the consumer for the initial transaction, the payments received for the returned goods and the delivery costs, if any, without undue delay and, in any case, before 14 calendar days have elapsed from the date on which it has been informed of the Client's decision to withdraw from the contract. This condition will only be met as long as the original packaging is available and provided that the product has not undergone any modification from its original state of manufacture.

To exercise the right of withdrawal, the Client must communicate, within this period of 14 calendar days from delivery, by telephone + 34 660 832 041 or through the email address pedidos@eco-blu.es from 06:00 h to 15:00 h from Monday to Thursday and from 06:00 h to 14:00 h on Fridays.

Return

Once the period for exercising the legal right of withdrawal has elapsed, ECO-BLU offers the Client an additional guarantee to the legal one, of return or exchange of the products purchased, which may be made effective by the Client within 30 days of purchase.

Once the condition of the goods has been verified in the exercise of this commercial guarantee, if the product has not been handled and maintains its original packaging, ECO-BLU will refund the amount of the purchase of the product, by the same payment method that the Customer used within three working days of receipt.

If no original packaging is available or the product being returned has been opened, removed from the packaging, assembled and used, no return will be accepted.

The Client will be responsible for the decrease in value of the products to be returned resulting from handling of the same unrelated to that derived from their nature, characteristics and/or operation, which will mean that in such cases the exercise of the right of withdrawal or the commercial guarantee of return offered by ECO-BLU will not be admitted.

To exercise these rights and guarantees, the Customer must in any case present proof of purchase of the products.

12. WARRANTY

By virtue of the provisions of Royal Legislative Decree 1/2007 of 16 November, when the Customer is a consumer within two years of delivery, ECO-BLU will be liable for manufacturing defects in the items purchased. Once the existence of a manufacturing defect in the product has been verified, ECO-BLU will proceed to repair the product or, where appropriate, replace it. If both solutions are not possible, the Client may request a proportional reduction in the price and, if the defect is serious, the termination of the contract.

The Client is obliged to report the defect noticed within one month of the time it becomes noticed. ECO-BLU offers a commercial warranty for certain products, in addition to the legal one, of five years warranty against manufacturing and/or material defects, on a voluntary basis (commercial warranty).

The commercial guarantees offered by ECO-BLU with respect to its products are conditional on a good use of the product. This warranty does not apply in the event of evidence of a different use, for example improper handling that modifies the original condition of the product.
